Subsidies 2014 for the incorporation of working partners or work partners in cooperatives and labor societies

It is regulated by Order EMO / 308/2014 of October 15, published in the DOGC. From October 22, 2014.

Application deadlines: it is 10 calendar days from the publication, that is, from October 22, 2014 and until October 31, 2014.

The presentation of applications can be made to any office of the network of business management offices (OGE) indicated in Canal Empresa (www.gencat.cat/canalempresa/xarxa), along with the documentation that foresee the bases of the Referred to regulating regulations for these subsidies.

The cooperatives and labor societies may be beneficiaries.

The requirements to obtain the status of beneficiary are, among others: have a work center in Catalonia, irrespective of the place of their registered office or of the register where the cooperative or labor company is registered.

At the same time, it is also requested as generic requirements:

Give employment to at least 2% of workers with disabilities in the workforce of the company.

To comply with the Tax obligations, with the Generalitat de Catalunya and towards the Social Security, a situation that must be maintained throughout the procedure, that is, prior to the moment of the application and to be able to receive any of the payments .

Not having been sanctioned the beneficiary organization for work-related infractions of disabled persons or very serious in labor relations or health and safety at work.

Having established a system of organization and management of occupational risk prevention.

Respect equality of treatment and opportunities between men and women.

The beneficiary entities are legally constituted and registered in the corresponding registries and up to date with the registration obligations.

It is imposed as obligations:
Maintain working partner status for at least two uninterrupted years.
The cooperative economy company must allocate the net amount of the subsidy to a special reserve provided that the part of the surplus obtained, net of the amounts allocated to the fund and legal reserves established, is greater than the net amount of the Subsidy This reservation will be non-scalable and can only be applied to cover losses

The incorporation of working partners or work partners in a cooperative or a labor society included must be done with someone included in one of the following groups:

A) Unemployed people
B) Workers linked to the company with a fixed or temporary employment contract.

The incorporation will have to suppose the maintenance or an increase of employment with respect to the average of the 12 months previous to the date of incorporation of the new partners for which the subsidy is received. For the purposes of calculating the increase in employment, the number of worker or work partners and the number of workers with an indefinite contract will be considered.

People who join as working partners or as work partners must meet the following requirements:
A) With respect to those people who are unemployed, they must be registered in the corresponding employment office prior to their incorporation as a member.
B) With respect to the workers of the company, they must be registered in the general Social Security system prior to their incorporation as partners.
C) These subsidies can not be granted in the case of incorporations of working partners or work partners who have enjoyed this condition in the same company in the two years prior to their incorporation as partners.

The temporary scope to which the subsidy refers is for incorporations from October 22, 2013 and until October 33, 2014:

In the case of workers linked to the company with a fixed or temporary employment contract, the date of incorporation as partners in the cooperative or labor company will serve for the fulfillment of the temporary scope.

In the case of unemployed people, the date that will be taken into account for the fulfillment of the temporary scope will be the one of the discharge to the corresponding regime of the Social Security.

The maximum amount of the subsidy will be gradual according to the following groups:

• Maximum amount of € 5,000 for the incorporation of disabled people as partners working in cooperatives or labor societies.

• Maximum amount of € 3,000 for the incorporation of people under 30 years of age or over 45 years as partners working in cooperatives or labor societies.

• Maximum amount of € 2,000 for people not included in the previous groups, when they are incorporated as partners working in cooperatives or labor societies.

In the case of support compatibility, it is necessary to say that the regulated aid is incompatible with any other aid granted for the same purpose, except when it comes to the partial financing of the project and has been defined precisely in the request for the aid The part subsidized by the Department of Enterprise and Employment.

The amount of the grants granted in no case can be of a quantity that, isolated or in concurrence with subsidies of other public or private entities, national or international, exceeds the cost of the activity to be developed by the beneficiary.
